　２０１６年５月２４日、「本邦外出身者に対する不当な差別的言動の解消に向けた取り組みに関する法律」（通称ヘイトスピーチ解消法）という奇妙な名前の法律が成立しました。これは、実は国連人種差別撤廃委員会が２０１４年に日本政府に出した勧告がきっかけとなってできた法律です。　

しかし、この法律は明らかに、日本人を差別する法律であり、人種差別撤廃条約に違反しています。

　なぜかというと、この法律の趣旨は「人種差別等を理由にした不当な差別的言動の解消」に向けられるはずなのですが、「本邦外出身者にたいする」という表現になり、「日本人に対しては」問題にされないのですからです。簡単に言えば、本邦外出身者＝韓国・朝鮮人に対する不当な言動はいけないが、日本人に対しては、どんな不当な発言をしても問題にされないということです。

　そもそも、国連の勧告なるものは、在日系の活動家ＮＧＯが持ち込んだレポートをもとに作られたものです。日本人のヘイトスピーチを一方的非難しており、在日韓国・朝鮮人が歴史捏造などに基づく日本非難のヘイトスピーチをしていることは一切無視したレポートが基になっているわけです。

　この法律は、「ヘイトスピーチ」の定義があいまいなこと相俟ってすでに日本人の表現の自由を抑圧するケースが起きています。

　１９１９年に日本が国際連盟に人種差別撤廃提案をしてから、１００年になろうとする今、世界にまれな人種差別法案が日本に存在していることは、はなはだ残念であり、悲しいことです。一刻も早くこの差別法案は撤廃すべきであります。

NGO Report in relation to the tenth to eleventh periodic reports of Japan

Series No. 5: 4. The Elimination of Hate Speech

Submitted by the Japan NGO Coalition against Racial Discrimination

The fourth report of the Japan NGO Coalition is “4. The Elimination of
Hate Speech.”

Based on the recommendation from the Committee on the Elimination of Racial
Discrimination in 2014, in May 2016, the “Act on Promotion of Efforts
towards Elimination of Unjustifiable Discrimination Letters to Outside
Japan”, the so-called Hate Speech Removal Act, was established in Japan.
The alleged purpose of this law was to abolish racial discrimination,
but this law in fact discriminates against Japanese citizens.
This law narrowly defines speech involving “Persons Originating from
Outside Japan”, such as Koreans in Japan, as “hate speech” and does
not address hate speech against Japanese people. According to this law,
hate speech against Japanese people is not an issue at all.

The phenomenon of hate speech has a number of sources. In response to
Korean hate speech, some Japanese people have denounced Korean hate speech.
Do not forget this basic point: we cannot think about measures against
“hate speech” without considering the cause of “hate speech”.

This law should be changed to an Act “On the Promotion of Efforts to
Eliminate Unfair Discriminatory Speech and Behavior Based on Racial Bias
and Other Forms of Discrimination,” which would be fairly and equally
applied to every person living in Japan.

This NGO report urges the immediate abolishment of the current
unreasonably racist law.
